On November 24, the ASEAN Secretariat held an online meeting for the General Administration of Customs of China to introduce regulations on registration of enterprises importing food into China (Order 248), Measures to manage imported food safety. to China (Order 249) to the Competent Authorities, representatives of relevant associations of ASEAN Member and answer the problems of ASEAN Member.
Attending the Vietnamese side were representatives of agencies: SPS Vietnam Office, Departments: Plant Protection, Veterinary Medicine, Quality Management of Agro-Forestry and Fisheries (Ministry of Agriculture and Rural Development), Food Safety Department (Ministry of Health), Science and Technology Department, Asia – Africa Market Department (Ministry of Industry and Trade), associations, industries and some related businesses.
The conference heard representatives of the General Administration of Customs of China present the main contents of Order 248 and Order 249. On the basis of questions from ASEAN members and Vietnam, the General Administration of Customs of China answered a question. Key information is as follows:
1. For 4 types of products registered and granted codes (meat and meat products; aquatic products; dairy products; bird’s nests and products from bird’s nest), these codes continue to be valid. according to regulations between the competent authority of the country (exporting area) and the General Administration of Customs of China.
2. Order 248 only applies to processing – production – preservation enterprises, not to commercial enterprises.
3. Before January 1, 2022, the competent authority of the country (exporting area) can use two forms: Register on the website: singlewindow.cn or according to the current method between the two parties. After January 1, 2022, the competent authority will log on to the website: singlewindow.cn of the General Administration of Customs of China to register. If the competent authority of the exporting country and the General Administration of Customs of China have an agreement on documents and registration methods for 18 types of products in the list mentioned in article 7, Order 248, the enterprise registration dossier shall Foreign businesses starting from January 1, 2022 will be submitted via the online system.
4. For 14 types of products according to note No. 353 without submitting the enterprise list on time before October 31, 2021, or exporting to China for the first time for 14 types of products, from As of January 1, 2022, the provisions of Article 8, Order 248 will be applied to register.
5. For enterprises that have completed their registration documents and submitted them before October 31, 2021, the results will be announced by the General Administration of Customs of China in the second half of December 2021.

Registration dossiers of self-registered enterprises can be searched on the registration link of the General Administration of Customs of China (using registered names and accounts) of enterprises to look up information about results, additional processing of records, status of records… All records and registration information of enterprises when logging into the system are confidential. The enterprise’s registered account (account name, password) must be self-preserved and not shared to avoid information loss. The form of enterprise registration through the Competent Authority and the form of self-registration of enterprises can be carried out at the same time.
9. When registering an enterprise, each product of each enterprise will be granted a separate code by the General Department of Customs. Enterprises with many products will be issued with corresponding codes. Allow 01 manufacturing factory to register multiple products with the General Administration of Customs of China, not allowing multiple manufacturing factories to use the same registration code.
10. From January 1, 2022, when declaring customs procedures for export shipments, the dossier must declare a code issued by the General Administration of Customs of China. If the registration is not completed, the shipment will not be cleared.
11. Pursuant to Article 19, Order 248: When changing the legal representative of the registered enterprise/factory or the registration number issued by the competent authority of the exporting country is changed, the form shall not be implemented. change registration to adjust and submit new registration documents and documents according to the registration process on the system. After the new registration file is approved, the code previously issued at the General Administration of Customs of China is automatically canceled. Before the time when the enterprise issues a new registration code at the General Administration of Customs of China, based on the issued code to declare customs, from the effective time of the new registration code, the enterprise must base new code for customs clearance.
With the goal of not disrupting trade between ASEAN members – China, during the implementation of the 2 Orders, the General Administration of Customs of China will review the agricultural trade situation of the two sides to make reasonable arrangements. The General Administration of Customs of China requested relevant parties to complete the business registration by December 31, 2021. At the same time, the General Department of Customs of China hopes to receive the coordination and support of the competent authorities of ASEAN members. The General Administration of Customs of China hopes that the ASEAN Member’s authorities will strictly implement their management responsibilities and businesses also actively comply with these two orders.
