In Vietnam, the level of enterprise compliance is an important basis for the Customs authorities to apply preferential policies, facilitate procedures, and is an essential factor for the decision to classify goods for inspection. chemical.

With the goal of facilitating trade, reducing costs for businesses, reducing the rate of physical inspection of imported and exported goods, overcoming difficulties and obstacles in carrying out customs procedures, establishing partnerships trust between customs authorities and enterprises, the General Department of Customs has just issued Decision No. 1399/QD-TCHQ on Pilot program to support and encourage businesses to voluntarily comply with customs laws.

Accordingly, businesses participating in the Program will be facilitated by the Customs, providing free guidance on contents related to the fields of application of risk management, compliance with customs laws and implementation of the law. customs procedures for imported, exported and transited goods.

Set a target that 100% of businesses will not be handled for violations

The program is implemented in two phases: The pilot phase is carried out for 2 years from the date of issuance, the pilot phase ends, the pilot phase will be summarized to measure, evaluate, and amend and supplement. supplement the Program to match actual requirements.

The official implementation phase is held for a preliminary review once a year, after 5 years the Program will organize a review, measure and evaluate the results of the implementation of the Program’s objectives and implementation orientation in the next period. follow.

Thereby, the General Department of Customs has set a requirement that, after 2 years of implementation, 100% of enterprises participating in the Program will not be handled for violations of the customs law in Appendix VI of Circular 81. assess the level of legal compliance at level 2 (high compliance), level 3 (medium compliance).

Classify the level of legal compliance for customs declarants according to 5 levels corresponding to recommendations from 1 to 5.

At the same time, the data and information indicators related to the management, monitoring and reporting of the Program implementation as well as interaction activities with enterprises participating in the Program are basically implemented on a digital platform. , meeting the requirements of digital transformation of the Customs sector (according to Decision No. 707/QD-TCHQ on approving the Plan on digital transformation of the Customs sector up to 2025 with orientation to 2030).

Focus on outsourcing and exporting work group

According to Khuat Thanh Trung, a representative of the Risk Management Department, in the first stage of implementing the pilot program, the Customs authority will focus on the group of import-export enterprises in the field of processing, manufacturing and exporting. Exports at 6 Customs Departments including Hanoi, Hai Phong, Bac Ninh, Ho Chi Minh City, Binh Duong and Dong Nai to accompany and support businesses to recover production after the pandemic, then expand to all business objects.

After 5 years of implementation of the Program, through supporting activities and voluntary compliance of enterprises, strive to increase the rate of enterprises complying with level 2 and level 3 to over 20% of the total number of enterprises operating in export activities. import.

Within the framework of the Program, participating enterprises will be facilitated, supported and guided by the Customs authorities on contents related to the fields of application of risk management and compliance with customs laws. and carry out customs procedures for imported, exported and transited goods.

Specifically, participating enterprises are supported and guided by the Customs for free according to the commitments in the memorandum of understanding to enterprises upon request; be recognized by the Customs as a member, the participation process on the enterprise file and the professional systems of the Customs to ensure the timely, effective and correct implementation of support activities. subject.

At the same time, enterprises are also assigned by the Customs to arrange customs officers and experts at all levels to directly support, consult, and contact to solve problems, warn of factors that reduce the level of tax. compliance level of enterprises, and at the same time provide warning information, risk trends in supply chain security, intellectual property infringement in the field of import and export, internal risks in import and export activities. export.

In the process of developing a pilot program to support and encourage businesses to comply with customs laws, the General Department of Customs has studied the Customs-enterprise pillar standards (SAFE Framework of Standards) and the recommendations of experts. member of the United States Agency for International Development (USAID). At the same time, study the experience of the Customs of countries such as the United States, China, Australia, Indonesia, India … to apply and build a pilot to support enterprises to comply with the law.
