Decree 38/2024/ND-CP regulates administrative violations, forms, levels of penalties, remedial measures, authority to make records and authority to sanction administrative violations mainly in the fisheries sector.

The maximum fine for an administrative violation committed by an individual in the fisheries sector is 1 billion VND. In case an organization commits the same violation as an individual, the fine is equal to 2 times the fine for an individual.

Specifically, the Decree stipulates that violations of regulations on protecting the habitat of aquatic species are subject to fines ranging from 5 – 200 million VND depending on the violations.

For any of the acts of exploring, exploiting natural resources, constructing or demolishing underwater structures or underground structures that reduce or lose aquatic resources or cause damage to the living environment or area. breeding areas, areas where young aquatic animals live, and migratory routes of aquatic species; Failure to create migration routes or reserve movement corridors for aquatic species when constructing, changing or demolishing structures or engaging in activities related to aquatic species’ migration routes will result in a fine of 150 – 200 million VND. .

Violating regulations on fishing in prohibited areas will result in a fine of up to 90 million VND

Regarding regulations on fishing in prohibited areas, the Decree stipulates a fine of 70 – 90 million VND for the act of using a fishing vessel with a maximum length of 24 m or more for trawling and trawling. and fishing gear combined with light (except squid fishing) for fishing in areas where fishing is prohibited or areas where fishing is banned for a limited period of time but not to the extent of being prosecuted for criminal liability.

Violations of regulations on management of endangered, precious and rare aquatic species are subject to fines ranging from 10 – 200 million VND.

Violations of regulations on marine protected area management are subject to fines ranging from 50 – 200 million VND.

For violations of regulations on aquatic breeds, the Decree stipulates a fine of 40 – 50 million VND for the act of producing and rearing aquatic breeds that are not on the List of aquatic species permitted for business in Vietnam. Men either have not been recognized or have not been permitted by the competent authority but have not yet reached the level of criminal prosecution.

Violations of regulations on aquatic feed and aquaculture environmental treatment products are subject to fines ranging from 2 – 50 million VND.
