At the preliminary conclusion, ADC said that ammonium nitrate products originating from Lithuania and Vietnam were dumped during the investigation period (from April 1, 2021 to March 31, 2022).
However, after analyzing the damage, ADC concluded that ammonium nitrate products originating from Lithuania and Vietnam did not cause injury or threaten to cause damage to Australia’s domestic industry.
Therefore, ADC proposes not to impose anti-dumping tax on ammonium nitrate products originating from Lithuania and Vietnam.
It is known that ammonium nitrate products are import from Lithuania and Vietnam account for only about 0.8% and 0.2% of the ammonium nitrate market share in Australia, respectively.
Previously, the case was initiated by ADC on June 8, 2022 with 3 countries: Chile, Lithuania and Vietnam. In August 2022, ADC announced the termination of the investigation with Chile because the country did not export ammonium nitrate products during the investigation period.
The Trade Remedies Department said that during the course of participating in the case, Vietnam’s ammonium nitrate producer fully cooperated and provided information to ADC, including the investigation questionnaire and verification. information intelligence. ADC also confirms that the information provided by Vietnamese enterprises is correct.
According to the plan, the deadline for the parties to submit comments on the State of Essential Facts (SEF): within 20 days from the date of publication of the SEF (expected to June 19, 2023); the time ADC issues the final investigation conclusion on 8/8/2023; The date the Australian Minister of Industry, Science, Energy and Resources officially issues the Decision (expected): within 30 days of receiving the Final Investigation Conclusion.
